POLITICAL SIGNS: Are they permitted?
Article 4.3 ( f )
With the elections right around the corner on May 22, 2018, please be reminded that political signs are NOT permitted throughout Cool Springs community. Cool Springs’ restrictive covenants prohibiting all signs, other than 6 square feet real estate signs, includes political signs and does not violate the homeowner’s First Amendment rights. Please realize that this restriction is not originating from municipality acting under the color of state law but rather a private contract. By purchasing into the community, homeowners willingly entered and agreed to the restrictions and conditions as outlined within the Declaration of Covenants, Conditions, Restrictions, Liens, and Reservations of Easements for Cool Springs. The intent of the parties entering the agreement is pursuant to a desire for uniformity, organization, and aesthetic appeal. The goal of Article 4.3 ( f ) sign restrictions of Cool Springs are aesthetic in nature and not content based. Therefore, by owning within Cool Springs a covenant between consensual private parties was entered with like intent to preserve the organized and aesthetic qualities of the community, including sign restrictions.
